This strikes me as a far and away over reaction. So basically: Hibs have been playing p*sh. This bloke, rightly or wrongly, critiscises a Hibs player for being p*sh recently. We all agree it wasn't the right time to do it, but we all agree the man is entitled to his opinion and has a right to voice it. He has after all paid the best part of £400 on his seat alone, never mind transport food etc. and lots more if he travels away. Entirely unprofessionally, a Hibs player and the management team get into a slagging match with this bloke. He is then banned until the end of the season. This smacks of really poor practice by Hibs - Huns come to ER 2 or 3 times a season and spout filth all day long, where they banned? A bloke near me was reported and taken aside by stewards last season for racially abusing Bobo Balde, he wasn't banned (was back next game). Yet when the management and playing staff get a raw nerve touched we ban someone for 3 or 4 games? Get real Hibs, this is a shocking policy.

How is it shocking policy?

If what has been said is true, and the guy has been banned only until the end of the season, then I think Hibs have taken the "sting" out of what could've been an embarrassing incident for the Club as a whole.

If the police wanted to investigate further, but are happy to leave it because of the clubs course of action, then the guy may have been let off lightly.

Does'nt matter a fuck if the guy has paid £400 for his seat, when we go to games to support Hibs then we, as fans, have a responsibilty to give the team the best support we can. Slagging a player off, before he has even taken part in the game, would have the opposite effect to why this guy is actually there, ie, SUPPORT HIBS


To me it looks like the Club has handled it well so far, but I hope they have a follow-up to this with the guy on face-to-face, before they give him the opportunity to renew for next season. A sort of "clear the air" meeting with all concerned.

Breach of the Peace.

Its a coverall charge that the police use to do you for basically anything.

And under the Criminal Justice(Scotland) Act, not only can you end up with a fine, or even jail(depending on the severity) it can also have you binned from every fitbaw ground in Scotland. To impose this ban the court would make you turn up at your local nick at 3.00pm every saturday(or whenever Hibs are playing).

I take your point on Breach of the Peace, although I think the guy would have had a pretty strong defence in court, if it came to that. Being based upon the facts that:
- thousands of football fans in the stadium 'abuse' and get on at players all of the time
- he wasn't abusing him for race/nationality/religion/sexuality/colour/occupation/age
- as far as I know, no-one 'independent' of the dispute reported him as an offender
- Collins, Craig, Sproule retorted just as bad if not worse, thus also Breach of Peace?

It does'nt matter how strong your defence is, people very rarely walk away from court with a Not Guilty verdict on Breach of the Peace once it has been established that you are a fitbaw fan. The polis & courts treat fitbaw fans as "the guilty bastards" per se, sometimes even before you've committed a "crime". They basically view fitbaw fans as criminal statistics in the making.

On your last point, do you not think this is why Hibs have banned the guy until the end of the season, and kept the polis out of it?
I saw what their reaction was to the guy, although it was'nt what I would call overly aggressive, it may have been constituted as a Breach by the bizzies, and to what I implied earlier as an embarrassing situation for the club as a whole.

Technically it wouldn't be Breach of the Peace as no Breach had taken place, behaviour likely to occassion BOTP is, IME, the polices favourite to lift somebody for although down here the CPS are highly unlikely to proceed. CJA Scotland does raise up a few anomalies with regards to football banning orders as you do not have to be convicted of a related crime in court to be issued with one

Spectators persisting in the use of foul and abusive language will be liable to ejection and possible banning from the Stadium.
