Second bite at the apple?

Curious as to the reactions of fellow bouncers regarding this article.

Is it born out of frustration of the truly criminal using the law to their benefit, or part of a larger goverment move to exert more control and "get their man"?

How does this impact the "not proved" verdict also?

Hey Burbank when I clicked on your link I got this headline UUP-PUP link 'against the rules' and wondered what the feck it had to do with "double-jeopardy" so I can only assume you refer to the dude who is in court after 15 years for killing Julie Hogg. TBH as I dont have anything to hide I am all in favour of the change in the law but doubtless there will be some who cry Foul and prattle on about the law change being an infringement of civil liberties et al. If it means people who commited crimes and initially got awayy with it get prosecuted then fair enough. I havent read much about it, how did the change in the law come about, was it something to do with evidence gathering being more accurate now or somethin - I was thinking DNA testing when I typed that.

The position appears to be that the centuries-old principle that an accused cannot be tried twice for the same offence has been set aside, but that a second trial can only be called when there is clear new evidence of the accused's guilt. In other words it cannot be used to overturn an unpopular not guilty (or presumably not proven) verdict, but it can be used to convict an accused who escaped conviction first time round due to lack of evidence.

Two types of cases seem likely to be caught - ones like the current one where the accused has subsequently admitted guilt safe in the knowledge that regardless of whether further evidence of guilt comes to light, he or she cannot be retried and has thus effectively "cheated" the criminal justice system; and cases where advances in DNA science mean that accused who were not convicted at the time due to lack of forensic evidence may now be retried using better analysis techniques on samples taken at the time.

It seems fair enough to me, but no doubt Sybil Libbady and her mates will be crying foul as usual.
