I can understand the sympathy for the woman in this case- it is her only chance to have a child of her own and and I'm sure that can be a pretty powerful driver. However, the embryos are as much his as they are hers and I don't think she should be allowed to have a child that is his without his consent.

Take the flip side of this argument. Say he had testicular cancer and can now no longer have children, but these embryos from a previous relationship exist. Would courts allow his new wife/girlfriend to be impregnated with one of these embryos, against the wishes of his ex?
